TERMS AND CONDITIONS FOR TICKET HOLDERS OF [THAALAM SUMMER FESTIVAL]
By submitting the ticket status selection form to Thaalam Media ("Organizer"), you agree to be bound by the following terms according to your chosen option.

1. Ticket Holders Requesting a Refund

a) Refund Eligibility: Refund requests must be submitted via the official form by the deadline set by the Organizer. Only tickets purchased through authorized channels and directly related to the rescheduled event are eligible. Refunds are granted solely due to the rescheduling caused by technical or logistical reasons announced by the Organizer.

b) Refund Process: Upon validation of your eligibility and receipt of requested documentation, refunds will be processed using the original payment method within a reasonable time frame communicated by the Organizer. The refunded amount equals the ticket face value and excludes any service fees or other costs.

c) Waiver of Rights: By requesting a refund, you irrevocably relinquish any rights to attend the rescheduled event or any related future events under the original ticket. You also waive any claims for additional compensation related to the rescheduling, including but not limited to travel, accommodation, or other incidental expenses.

d) Ticket Invalidity: Upon refund issuance, your ticket(s) become null and void, and any attempt to use, resell, or transfer refunded tickets is strictly prohibited and may result in legal action.

e) Final Settlement: Your refund request and these terms constitute a full and final settlement of your ticket purchase obligations with no further claims allowed against the Organizer.

2. Ticket Holders Opting to Retain Validity for the Rescheduled Event

a) Event Reschedule and Ticket Validity: By electing to keep your ticket valid, you acknowledge and agree that your ticket will be valid for the new event date, which shall be determined solely at the Organizer’s discretion, with no obligation to notify you until official announcement.

b) Seat Selection and Ticket Category: If the event involves assigned seating, you will be granted the opportunity to select your seat(s) in accordance with the Organizer's policies. Ticket category and pricing for the rescheduled event may differ and will be communicated exclusively by the Organizer. The Organizer reserves the right to offer ticket categories at prices equal to or higher than your original purchase; these terms shall be final and binding.

c) No Refunds After Selection: Upon confirming your intent to keep your ticket valid, no refunds or exchanges will be permitted, regardless of the event date, seating, or ticket category changes.

d) Organizer's Rights: The Organizer reserves the right to verify ticket authenticity and holder identity upon admission, and may refuse entry for violations of these terms.

e) Acceptance of Terms: Your submission of the form with the “Remain Valid” choice signifies a binding agreement, waiving any claims for compensation, damages, or grievances related to the event’s rescheduling, seat allocation, or ticket category changes.

3. General Provisions

a) Confidentiality: All communications from the Organizer to the ticket holder—including emails, announcements, forms, and any related correspondence—are strictly confidential and may not be disclosed, published, distributed, or shared without prior written consent of the Organizer. Breach may result in legal action under Swiss law. This obligation survives beyond the event.

b) Waiver of Legal Claims: You irrevocably waive any and all rights to initiate legal action, claims for compensation, damages, or disputes arising from or related to your ticket status selection and its consequences once the form is submitted.

c) Governing Law and Jurisdiction: These terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich.

d) Enforceability: The Organizer reserves the right to seek all remedies available under law or equity for breaches of these terms, including injunctive relief and damages.

e) Data Protection and Privacy: The Organizer will process personal data submitted through the ticket form in accordance with applicable data protection laws (such as the Swiss Federal Act on Data Protection) and uses the data only for event-related purposes. By submitting the form, ticket holders consent to such data processing.

f) Digital Acceptance and Binding Agreement: Tick boxes or electronically signed consents on the website form constitute legally binding acceptance of the full Terms and Conditions by the ticket holder. Submission of the form is deemed as the full and final agreement acknowledging all rights, obligations, waivers, and contractual terms without reservation.

By submitting your selection via the official ticket status form, you confirm that you have read, understood, and unconditionally accept these Terms and Conditions as final and binding.
